How is it possible for the seller to put stipulations on the land use if you purchase it? Can't you do what you want once you are the owner?
Valentine Cadieux

The way that “property” law works here is that the idea of “property” is a bunch of different relationships you can have with land. So what you’re able to do is shaped by lots of layers of context: tribal uses, federal and state rules, county (and here, Met Council) rules, city rules — and also any deed restrictions of the specific parcel or the neighborhood.
Valentine Cadieux

(It can be very confusing. The bright side, given the way the ECONOMIC system works here, is that it means you can’t have someone move in next to your farm and put an oil refinery...)

What an incredible story. Congraultations on your accomplishments, Moses.

Yes, we have to perhaps think of controlling land not always ownership, especially when staring out.

If using an LLC then does the LLC own the land? What if you want to build a home on LLC owned land - how does ownership work then? Would the LLC own the home?
Valentine Cadieux
01:21:46
There are a lot of models!
Valentine Cadieux
01:22:50
For context, these “corporate farm laws” (in MN and WI, and a handful of other states) are rules designed to protect “family farms,” but they define families narrowly.

01:23:28
Who is a good lawyer you recommend to look over how to establish LLC that you can refer us to?
Valentine Cadieux
01:23:34
And some people, Cathy, use condo rules, for example — there are a lot of ways to do this, and part of what we’re hoping is to make it easier to share models.
Valentine Cadieux
01:23:56
The main public interest law crew here I’d recommend is FLAG — Farmers’ Legal Action Group.

01:24:31
The smaller law firm Farm Commons works on these issues, too, I believe.

Is this land trust method what is happening in the creation of intended communities that have agriculture as their mode of living?
ZOFEYAH MCBRAYER
01:45:12
Richfield used to have a community garden on Minneapolis land by the airport, but they closed it. It was a really nice site with decent soil I think that could be available--city of Richfield just didn't have time for it.
